Terms of Use

This English version is a reference translation. The Japanese version is the legally binding text; in case of any discrepancy, the Japanese version prevails.

These Terms of Use ("Terms") govern the use of the mobile application "Yolopic" ("Service") provided by Jujutech (sole proprietorship; "we," "us," or "our"). By using the Service, the user ("you") is deemed to have agreed to these Terms.

Article 1 (Application)

1. These Terms apply to any and all relationships between us and you regarding the use of the Service.
2. Any individual rules, guidelines, or notices posted within the Service form part of these Terms. If individual rules conflict with these Terms, the individual rules prevail.

Article 2 (Description of the Service)

The Service generates candidate ID photo images using artificial intelligence (AI) based on facial photographs uploaded by users, and enables viewing, downloading, and related operations. The specifications, features, and pricing of the Service may be changed at our discretion from time to time.

Article 3 (Eligibility)

1. The Service may be used only by individuals who have agreed to these Terms.
2. Users under the age of 18 may use the Service only with the consent of a parent or guardian.
3. Any person whose use of the Service has previously been suspended for breach of these Terms or similar reasons may not use the Service.

Article 4 (Account and Anonymous Authentication)

1. The Service uses anonymous authentication via Firebase Authentication. You may use the Service without registering a name, email address, or other identifying information.
2. Data associated with the anonymous credential is tied to the device. If you change devices or reinstall the app, you may lose access to previously generated images. We provide a purchase-restoration feature within the Service but do not guarantee successful restoration in every case.

Article 5 (Photos, Generated Content, and Intellectual Property)

1. You may only upload facial photographs to which you hold the copyright and other necessary rights, or for which you have obtained the consent of the subject for use in the Service.
2. Copyright and rights of use in images generated by the Service ("Generated Content") belong to you, except for rights that may be retained by us under applicable law. You may use Generated Content for personal use and for submission as ID photos, etc.
3. We may keep internal records of the generation process and Generated Content for the purpose of quality improvement, defect investigation, and fraud detection. However, we will not use Generated Content or uploaded facial photographs to retrain AI models.
4. All intellectual property rights in the Service, including the app, website, logos, templates, designs, and other content comprising the Service, belong to us or to the rightful right-holders.

Article 6 (Fees and Subscriptions)

1. Certain features of the Service are available free of charge; other features (such as high-resolution image download) are paid features at the prices displayed within the Service.
2. Payment for paid features is processed through the App Store (Apple Inc.) or Google Play (Google LLC), and the terms and payment conditions of each platform apply.
3. Subscriptions renew automatically unless cancelled. Cancellation must be done through the subscription management screen of the App Store or Google Play.

Article 7 (Refunds)

Refunds for paid features of the Service are, in principle, governed by the refund policies of the App Store and Google Play. We are not involved in refund decisions made by these platform providers. However, if it is clearly the case that we were unable to deliver the goods or service due to a defect in the Service, we will respond on a case-by-case basis within reasonable limits.

Article 8 (Prohibited Conduct)

You must not engage in any of the following while using the Service:

• conduct that violates any law, court judgment, decision, or order, or any binding administrative measure
• conduct that infringes the rights of likeness, privacy, copyrights, trademarks, or other rights of third parties (including uploading another person's facial photograph without their consent)
• uploading the facial photograph of a minor without the consent of the minor's parent or guardian
• uploading photographs that violate public order and morals (obscene, violent, discriminatory images, etc.)
• using the Service for the forgery of official documents, impersonation, fraud, or any other unlawful purpose
• reverse-engineering, decompiling, gaining unauthorized access to, or placing excessive load on the Service
• commercially reusing information obtained through the Service without our prior written permission
• any other conduct that we reasonably determine to be inappropriate for the operation of the Service

Article 9 (Disclaimers)

1. The Service performs AI-based image generation and does not guarantee the quality, accuracy, or suitability of Generated Content for any official purpose. If you use Generated Content for official purposes (passport applications, driver's licenses, visa applications, etc.), you are responsible for confirming that it meets the specifications and requirements of the relevant submission authority.
2. We are not liable for any damages incurred by you or any third party as a result of the provision, modification, suspension, or termination of the Service, or the loss or alteration of data, except in cases of our willful misconduct or gross negligence.
3. Even where we cannot disclaim liability under the Consumer Contract Act or other applicable laws, our liability shall be limited to the amount paid by you to us for the Service during the twelve (12) months immediately preceding the occurrence of the relevant damage.
4. The Service relies on third-party services such as Apple Inc., Google LLC, and RevenueCat, Inc. We are not responsible for any impact caused by failures, changes, or termination of these third-party services.

Article 10 (Modification, Suspension, and Termination of the Service)

We may change the content of the Service, or suspend or terminate all or part of the Service, without prior notice to users. We are not liable for any damages caused to you or any third party as a result, except in cases of our willful misconduct or gross negligence.

Article 11 (Suspension of Use; Account Deletion)

If we reasonably determine that you have breached these Terms, we may suspend your use of the Service or delete related data without prior notice. You may delete your account at any time through the in-app settings.

Article 12 (Changes to these Terms)

We may revise these Terms as necessary. Material changes will be announced within the Service or on this page. Revised Terms become effective upon publication on this page. If you continue to use the Service after a revision, you are deemed to have agreed to the revised Terms.

Article 13 (Governing Law and Jurisdiction)

1. These Terms and all matters relating to the use of the Service are governed by the laws of Japan.
2. For any dispute arising in connection with the Service or these Terms, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
